Mindful Climbing Retreat | Bishop, CA | Oct. 2-5, 2024

In consideration of being permitted to participate in any way in: 

All activities related to a Mindful Climbing Retreat, organized by Aaron Solomon and others (where organizing includes offering guidance, logistical support, instruction, and information) from October 2-5, 2024 at Bishop, California, and where these activities may include but are not limited to, camping, cooking, driving and riding in vehicles, hiking, swimming, meditating outdoors, rock climbing, scrambling, bouldering, belaying, and repelling, hereinafter called “climbing,” “outdoor activities,” “retreat,” “activities,” or “retreat activities,” hereby agree as follows:

1. Inherent Danger and Risk: I understand and acknowledge that climbing and other outdoor activities, as well as travel by vehicle, are inherently dangerous activities with risks involving dangerous weather conditions, animal and insect bites or stings or other animal interactions, vehicle accidents, dangerous or toxic plants, dangerous terrain, rockfall, equipment failure or misuse, negligence or errors of others, and other unforeseeable risks. I understand and acknowledge that these risks can result in serious injury, permanent disability, or death. 

2. No Solo Climbing: I agree not to climb alone at any time while participating in this retreat from October 2-5, 2024.

3. Personal Recreational Activity: I understand that I am not offering any payment for guidance or services during this retreat and that all of the activities on this retreat are solely personal recreational activities. I understand that this retreat is not an officially led event of any organization. I understand that I am solely responsible for my safety in all climbing and other activities that I participate in during the retreat, and that no person or organization assumes any responsibility for me or my safety.

4. Assumption of Risk I am voluntarily participating in climbing and other activities on this retreat with knowledge of the dangers involved, and I assume all risks of injury, death, or property damage that may occur. 

5. Waiver of Liability I acknowledge that Aaron Solomon, as lead organizer, along with all other participants and organizers of this retreat, shall not be liable for any personal injury, property damage, or wrongful death that may occur as a result of my participation in this retreat. I understand and agree that this waiver of liability shall extend to anyone who participates in this retreat with me, or who offers me directions, suggestions, or instructions regarding climbing or any other activities, even if that person makes an error or is negligent. I understand that I am solely responsible for my safety and well-being while climbing and while participating in the entire retreat, including travel to and from the retreat.

6. Indemnification I agree to indemnify, defend, and hold harmless Aaron Solomon, and all other participants and organizers in the retreat, from any and all claims, actions, suits, or demands arising out of my participation in the retreat.

7. Sole Responsibility for Equipment I acknowledge that by using any climbing equipment, or any other equipment belonging to myself or to others for any purpose, that I assume full responsibility for the use of this equipment. I assume all risk and liability for using such equipment and understand that no warranty of any kind is made by the organizers and participants of the retreat for the fitness of any equipment used for any purposes related to climbing or any other retreat activities.

8. Health Certification I certify that I am in good health and have no medical conditions that would prevent me from participating in an outdoor camping retreat, in climbing outdoors, or in participating in any other activities of the retreat.

9. Binding Agreement I agree that this waiver of liability and assumption of risk agreement shall be binding on my heirs, executors, administrators, and assigns.

10. Inclusivity and Severability of Agreement I agree that this waiver and assumption of risks agreement is intended to be as broad and inclusive as permitted by law, and that if any portion is held invalid, that the balance shall, notwithstanding, continue in full legal force and effect.

11. Understanding of Agreement I have carefully read this waiver of liability,  assumption of risk and indemnification agreement and fully understand its contents. I am aware that this is a release of liability and is a formal contract between myself and all other participants and organizers of the Mindful Climbing Retreat as described above. 

I understand that by electronically checking the agreement box on my submitted form for this retreat that I am giving my full agreement to all parts of this document and that I am giving up substantial rights, including my right to sue. 

By checking the agreement box, I acknowledge that I do so freely and voluntarily.
